GENERAL CONDITIONS OF SALE
1.1 The terms indicated in these conditions of sale have the meaning indicated below, it being understood that the terms defined in the singular are also considered defined in the plural and vice versa.
Customer: any person (natural or legal person) who purchases one or more Products through the website www.aeroequipmentflyshop.eu, accepting these General Conditions of Sale.
Aeroequipment with registered office in Strada Brisciano 21 Marausa 91301 Misiliscemi prov Trapani, registered in the Trapani Company Register, CF TRPLS82D22D423W and PI no. 02678350816, as seller of the Products online
Parties: jointly Aeroequipment and the Customers.
General conditions of sale: these general conditions of sale and any future new versions that may be published on the Aeroequipment website.
Site: virtual shop, managed by Aeroequipment and accessible via the URL www.aeroequipmentflyshop.eu through which it is possible to purchase the Products.
Online Purchase and Sale Agreement: the purchase and sale contract of the Products concluded between Aeroequipment and the Customers through the Site.
Orders: purchase orders for Products sent by Customers, in accordance with the General Conditions of Sale.
Order Confirmation: the e-mail message through which Aeroequipment communicates to Customers the acceptance of Orders.
Price: the selling price of the Products as indicated on the Site corresponding to the Products themselves.
Products: the products published on the Site for the purpose of their sale.
Profile: means the area of the Site in which Customers can, after authentication: (i) view and modify their personal data and the addresses where the Products covered by the Orders must be shipped and delivered; (ii) access any other specific function relating to their activity on the Site.
2.1 The General Conditions of Sale govern all Sales Contracts and constitute an integral part thereof.
2.2 The display of Products and/or any services on the Aeroequipment Site constitutes an invitation to offer. The Customer's order is therefore considered as a contractual purchase proposal addressed to Aeroequipment for the products and/or any services selected.
2.3 Aeroequipment reserves the right to modify the General Conditions of Sale at any time, without prejudice to the fact that those published on the Site at the time the Orders are sent by the Customers will be considered applicable to the Sales Contracts.
2.4 Aeroequipment undertakes to send the Order Confirmation to the Customers within 2 working days of receipt of the Orders from the Customers.
2.5 The Sales Contracts are considered concluded between the Parties when the Customers receive the Order Confirmation.
2.6 By sending Orders, Customers declare that they have read all the information relating to the Products and have fully accepted the General Conditions of Sale.
3.1 For each Product published on the Site, Aeroequipment indicates whether it is immediately available at its logistics headquarters, without prejudice to the fact that the indication relating to the availability of the Products is not binding.
3.2 The type of Products published on the Site and their availability may vary at any time without this entailing any liability for Aeroequipment towards Customers. In the event of unexpected unavailability of a Product indicated as available at the time the Order was sent by a Customer, Aeroequipmet, without prejudice to the provisions of the art. 3.1, undertakes to indicate to this Customer, in a subsequent communication by e-mail, the indicative times expected for a new availability of the Product covered by the Order. The Customer may revoke the Order within 48 hours of receiving such communication from Aeroequipment (without prejudice to the right of withdrawal) by sending an e-mail to Aeromail@pec.it. In this case Aeroequipment undertakes to refund the amount paid by the Customer as quickly as possible and in any case within the legal deadlines.
4.1 The Price is expressed in € (Euros). The applicable Price is the one published on the Site at the time the Orders are sent by the Customers.
4.2 The Price is inclusive of VAT.
4.3 The Price does not include shipping costs. Aeroequipments reserves the right to ask Customers for a contribution towards shipping costs which may vary depending on the type of delivery, the quantity of Products to be delivered, their volume, their weight and their destination. The Customer will be able to choose the shipping method he prefers from those indicated on the purchase screen and the related cost.
4.4 in the case of international shipments, any taxes, duties, duties and other charges established by the laws of the State where the Products are shipped and delivered will be entirely borne by the Customers and paid by them upon delivery of the Products, directly to the competent tax or customs authorities or to the courier in charge of delivery.4.5 Product Prices may be updated and therefore may vary daily.
4.6 Any promotions or freebies offered by Aeroequipment are valid while stocks last and within the purchase limits indicated on the Site. The Promotional Products may be delivered in promotional packaging, different from those published on the Site. No replacement or return is possible in relation to any Products received free of charge by the Customer.
5.1 Customers can pay the Price and the contribution for shipping costs via PayPal or advance bank transfer. Aeroequipment reserves the right to change, at any time, the means of payment that can be used by Customers, it being understood that only the one published on the Site at the time of sending the Orders by the Customers will be considered usable.
5.2 If you choose to pay by credit or debit card, when the Customers send the Orders, the Web session will be transferred to the payment system. On this website, Customers can complete the payment for the Order using their credit card according to the conditions of use of the service itself which can be consulted on the payment service provider's website. If payment by advance bank transfer is chosen, Customers must pay within 48 hours of placing the order (under penalty of cancellation of the same). The reason to be reported on the bank transfer must indicate the name of the orderer and the date of the order. The bank transfer must be made to:

The order will be processed only upon receipt of the transferred amount.
5.3 If requested by Customers at the same time as sending Orders, Aeroequipment will send them an invoice via email. For the purposes of issuing the invoice, the information provided by the Customers is valid. No change to the invoice will be possible after its issuance by Aeroequipment.
6.1 Aeroequipment will ship the Products within 3 working days of payment of the order, or by prior agreement with the customer.
6.2 Aeroequipment guarantees the shipment of the Products, in the cities and states indicated on the Site, via courier. The Products are shipped by Aeroequipment via courier to the address indicated by the Customers when registering on the Site or to a different address indicated when sending the Order.
6.3 Customers can check the status of shipments thanks to the online "Order Tracking" function provided by the courier via its website. Aeroequipment cannot be held responsible for any delays due to causes occurring after the product was made available to the courier within the terms agreed in the order.
6.4 Customers are required to verify, at the time of delivery, that:
(i) the Products correspond to what is indicated in the courier's transport document both in number and type;
(ii) the packaging/packaging of the Products is intact, not damaged, nor wet or otherwise altered, including the closing materials.
6.5 Any damage to the packaging/packaging of the Products visible at the time of delivery must be immediately contested by the Customers by refusal of receipt or by placing a written control reservation on the courier's proof of delivery. It is understood that once the product has been accepted without reservation of control, no complaints can subsequently be sent to Aeroequipment.
6.6 Customers who have accepted the packaging subject to inspection and have subsequently found damage to the Product must, within 2 working days of delivery, communicate the damage to Aeroequipment by sending an e-mail to aeroequipment675@gmail.com A following notification of transport damage, Aeroequipment will replace the damaged product or return the amount paid by the Customer for the Order.
7.1 If Customers are "consumers" (i.e. a natural person acting for purposes unrelated to any entrepreneurial, commercial, artisanal or professional activity carried out), they have the right, pursuant to and for the purposes of Legislative Decree no. 206/2005 (Consumer Code), to withdraw from the Sales Contracts within 14 days from the date of receipt of the Products. The right of withdrawal must be exercised by Customers by sending Repainted a communication via e-mail to info@aeroequipmentflyshop.eu containing:
(i) the expression of intention to exercise the right of withdrawal;
(ii) the indication of the date of the Order subject to withdrawal, with specification indication of the model of the Product(s) being returned.
In any case, Customers will be able to use the Withdrawal Form made available by Repainted on the Site which must be duly completed and sent to Aeroequipment as an attachment (word or pdf format) to an email to be sent to info@aeroequipmentflyshop.eu
7.2 In case of exercise by Customers of the right of withdrawal:
(i) Customers undertake to return the Products within 5 working days from the date of the withdrawal notice sent to Aeroequipment, at the logistics headquarters in Strada Brisciano 21 loc Marausa cap 91031 Misiliscemi Prov Trapani. The shipment with which the Product is returned to Repainted, until Repainted receives the Product, will be under the responsibility and risk of the Customers;
(ii) all costs related to the return of the Products are entirely borne by the Customers;
(iii) Once the notice of withdrawal has been received, Repainted will confirm its receipt via email and refund the amount paid by the Customers for the Orders as quickly as possible, and in any case within 30 days from the date of receipt of the notice of withdrawal from referred to in the art. 7.1, provided that:
– the Products have been returned within the established deadlines;
– the Products have been returned intact;
– the Products have been returned complete with the original packaging, any accessories and Product labels in the same condition in which they were delivered.
7.3 Aeroequipment will reimburse Customers by crediting the same payment method used to pay for the order by credit card or bank transfer.
7.4 If Customers exercise the right of withdrawal in a manner that does not comply with the methods and terms set out in this article 7, they are not entitled to a refund.
7.5 As an alternative to exercising the right of withdrawal referred to in this art. 7, "consumer" customers (according to the definition in art. 7.1) can opt for a "product change" by agreeing it with Aeroeuipment. To this end, the Customer must send a specific product change request to Aeroeuipment by sending an email to info@aeroequipmetnflyshop.eu
8.1 Any defects/differences in the Products must be communicated by the Customers to Aeroequipment by email to info@aeroequipmetnflyshop.eu. In the event that, for any reason, Aeroequipment is unable to return a replacement Product to the Customer, it will proceed with the reimbursement. In any case, Customers must return the damaged product to Aeroequipment in the original packaging, agreeing on collection by the courier appointed by Aeroequipment, unless otherwise provided by Aeroequipment
8.2 In the event of failure to deliver the products by Aeroequipment within the delivery deadline, the Customer has the right to terminate the online Sales Contract by communicating this intention to Aeroequipment via e-mail at info@aeroequipmetnflyshop.eu. It is understood that Aeroequipment assumes no responsibility for disservices attributable to force majeure of any nature or kind, in the event that it is unable to execute the contract within the agreed times. Causes of force majeure include, by way of example and without limitation, accidents, explosions, fires, strikes and/or lockouts, earthquakes, floods and other similar events, as well as measures by the Public Authority, the strike of its own collaborators or of the couriers of which Repainted avails itself of, as well as any other circumstances that are beyond the latter's control.
8.3 Aeroequipment undertakes to constantly check the Site in order to avoid errors or inaccuracies. However, it is possible that the Site contains, or may over time contain, errors, inaccuracies or omissions. Aeroequipment therefore reserves the right to correct errors, inaccuracies or omissions contained in the Site even after an Order has been sent. Without prejudice to the right of termination of the Online Sales Contract by the Customers, Aeroequipment reserves the right to communicate to the Customers any errors in the publication of the information.
8.4 Without prejudice to the provisions of current legislation, Aeroequipment assumes no responsibility for any fraudulent use of Customer data possibly made by third parties on the Site or on the payment platform or on the web pages to which the Site can redirect via links.
9.1 Pursuant to art. 13 of Legislative Decree 196/03 Aeroequipment, as Data Controller of the personal data provided for the purpose of providing the services requested by Customers, publishes the Privacy and Cookie Policy information on the Site which Customers must view and expressly accept before placing the order as an obligatory step in the procedure for concluding the online Sales Contract.
10.1 All intellectual property rights with links to the Site (including the contents) are the exclusive property of Aeroequipment. The Site and its contents may not be reproduced either in whole or in part, transferred by electronic or conventional means, modified, linked and used for any purpose without the prior written consent of Aeroequipment.
11.1 These General Conditions, the Orders executed on the Site and the online Sales Contracts concluded through the Aeroequipment Site are governed by Italian law (and in particular by Legislative Decree 206 of 06/09/2005 and by Legislative Decree 70 of 04/09/ 2003) and subject to Italian jurisdiction.
11.2 Any dispute relating to the application, execution, interpretation of the General Conditions of Sale and/or the Sales Contracts will be exclusively competent by the Court of Trapani.
